"Guitar Hero" CEO Claims Kurt Cobain Avatar Use Is  Perfectly Legal

When the news came out that Kurt Cobain was an unlockable playable character in "Guitar Hero 5" and that players could make him sing other artists' songs (including Public Enemy and Bon Jovi), Nirvana fans were predictably outraged. So were Cobain's widow Courtney Love and his former Nirvana bandmates Krist Novoselic and Dave Grohl.

Love Twittered that she had never approved the usage of Cobain's image and threatened to sue. Grohl and Novoselic, for their part, issued a statement pointing out that they had no control over Cobain's image and urged game manufacturers Activision to re-lock the Cobain avatar so that he couldn't be made to wail Bush lyrics anymore.

So Activision has a little PR problem on its hands. But when NME reached out to "Guitar Hero" CEO Dan Rosensweig, he told a story that directly contradicts Love's: "I do know that there's absolutely a contract, and we know that the check has been cashed. I can only deal with the facts. It's very clear what the terms are." He added, "It's really not 'Guitar Hero''s confusion. We went and spoke directly to the estate and made it crystal clear, got the rights, paid for the rights, and really we've done what we've always done. The fact that the rest of the band and the estate did not communicate รข€“ I'm not aware of those facts [about their communication]
